Now there is a major update in the case. The accused, 23-year-old Akshay Shinde was appointed on a contractual basis to clean school washrooms on 1st August 2024. But within days, he allegedly raped the four-year-olds in the school's washroom. He was arrested five days after the children reported the assault to their parents, on 17th August 2024. The Bombay High Court, which had taken up the case on its own, had criticized the police investigation as the police had not followed the rules in the questioning of the children. The judges had said that police asking the victim and her parents to come to the police station for recording the statement was completely insensitive and against the law. The court also questioned the school for their process in selecting staff and allowing male cleaners and attendants inside girls' washrooms. The government later formed a Special Investigation Team (SIT) to probe the sexual assault case. Sources had said the SIT has sufficient evidence against Shinde. The SIT is also investigating the school as it allegedly did not comply with POCSO Act, which mandates that every authority, when they come to know about sexual offences on minors, is obliged to report it to the police. Two of the school's trustees are on the run. In a shocking twist, the accused was shot by the police. Shinde after his arrest was kept in Taloja jail. Shinde’s ex-wife had filed a complaint against him. She had left him five days after their wedding, has accused him of unnatural sex, rape and assault. The wife’s complaint case was being handled by Thane Crime Branch. Police officers from the crime branch had gone to Taloja jail to take custody of Shinde as they wanted to question him in connection with this new case filed by his ex-wife. The police team arrived at Taloja Jail with a court-issued warrant to take Shinde into custody. After completing the necessary formalities, they escorted him to a police vehicle around 5.30 pm. Along with Shinde, 12 police personnel were present in the van. On the route, near the Mumbra Bypass, between 6.00 pm and 6.15 pm, Shinde allegedly snatched a service pistol from API More and fired three rounds at the police personnel. He shot into the air and at officers. One bullet hit API Nilesh More in the left thigh.
In self-defense, another officer PI Sanjay Shinde fired a round at Shinde, critically injuring him. Both Shinde and API More were rushed to Kalwa Chhatrapati Shivaji Maharaj Civic Hospital, where Shinde was brought dead and his body was taken to JJ Hospital for a postmortem. Shinde’s mother, Alka Shinde, refused to accept the claims made by the police. She said that she had been waiting to meet him since morning, but was only able to meet him for 15 minutes at 4.30 pm. She said that Akshay had informed her that after she visited him last week, he had been beaten by the police. Alka also alleged that her son’s killing was planned and executed at the best of some political leaders. "My son feared Diwali crackers. It is unbelievable that he took a gun and shot some rounds.” She added that her son had always denied committing the crimes. “Even if he had committed it, the government and police should have faith in their own investigation. A fair punishment, even if it had been the death penalty, would have been justified. But this is a bigger crime and my son didn't even get a chance to fight his case. Akshay cannot do this, and I will fight for his justice.” The shooting incident is snowballing into a controversy ahead of the assembly elections in Maharashtra.
