Govt Makes Triple Talaq Illegal
In a historic win for Muslim women in India, the Parliament has passed the Muslim Women Bill and criminalised Triple Talaq.
Triple Talaq is an instant divorce. In this, a Muslim man says ‘Talaq’ which means divorce three times in oral, written, or more recently, electronic form. After doing this the man instantly divorces his wife. Many Muslims in India used to do this. Now The Rajya Sabha has finally declared that Triple Talaq will not be legal in India. The govt has passed the Muslim Women Bill (Protection of Rights on Marriage). According to the Bill if a Muslim husband pronounces talaq through written or electronic means. The divorce will be void and the man will be fined and jailed for 3 years.
If a woman’s husband has pronounced triple talaq on her. If any of her blood relatives or relatives by marriage inform the police, the police can file a complaint against the man.
If a man has been accused of Triple Talaq he will not get bail. Only after listening to the wife, if the judge is satisfied the man may get bail. A married Muslim woman will be given custody of the children in the event of a triple talaq. It is the right of the woman to receive some form of allowance if her husband gives her triple talaq.
It has taken 3 years for the govt to make triple talaq illegal. Many Muslim countries in the world such as Pakistan and Bangladesh had already made the law illegal. Now India has done it as well. The Bill will make sure Husbands are afraid to take such a step. After President Kovind signs the bill, it will become the law. The passing of the bill has now made sure that there is gender equality in the country. And no one is unfairly treated. PM Modi said that This extremely old law has finally thrown in the dustbin. The parliament has finally made sure that no Muslim woman will now suffer.
