Allahabad High Court reinstates Home Guard, who was fired for being Gay.
The Home Guard is an Indian Paramilitary force, which helps the local police in maintaining law and order. The Allahabad High Court recently directed that a Home Guard should be taken back in service. Recently, a Home Guard in Bulandshahr was removed from duty because of a viral video. In this video, he was seen displaying affection to his same sex partner. He was removed on the charge of indecency. The Home Guard filed a petition in the court.
Justice Sunita Agarwal of the Allahabad High Court quashed the order which cancelled the appointment of the Home Guard, by the authorities. The court said, display of affection among the members of the LGBTQ+ community towards their partners in public, cannot be looked down upon by the majority, as long as it doesn’t amount to indecency, or disrupt public order. Back in 2019, a Supreme Court order said that the sexual orientation of a person is his or her personal choice, and treating it as an offence would interfere with the right of privacy of the person concerned.
