Clashes had broken out between supporters of the Citizenship Amendment Act and others opposing it in North East Delhi in February. The fights killed 53 people and injured hundreds of people. The violence was the worst Delhi saw since the anti-Sikh violence of 1984. The Delhi Police had booked Safoora Zargar and another Jamia Millia Islamia student, Meeran Haider, under the Unlawful Activities (Prevention) Act (UAPA). 

The Delhi Police had arrested Meeran Haide and after a few days, Safoora Zargar was arrested for obstructing the road near the Jafrabad metro station on 23rd February. Civil society groups issued a statement on 16th April for the release of the two students. In the FIR filed, the police alleged that the communal violence was a “premeditated conspiracy” and was done by former Jawaharlal Nehru University (JNU) student Umar Khalid, Meeran Haider and Safoora Zargar. The students were also charged for sedition, murder, attempt to murder, promoting enmity between different groups on basis of religion and rioting.

It has been alleged that Saroofa made an “inflammatory speech” on 23rd February because of which violence and rioting started in North East Delhi. Earlier on 18th April and 2nd May also her lawyers had applied for bail. But those two times also the bail was rejected. This was the third time that too was rejected. The Patiala Court on 4th June again denied bail to pregnant Jamia Millia Islamia student Safoora Zargar. Additional Sessions Judge Dharmender Rana said, as per the Evidence Act, we have proof that the two students broke the law and gave inflammatory speeches. The judge also said that during the investigation, a larger conspiracy may be found. But the court asked the Tihar Jail medical superintendent to provide Safoora with proper medical aid as she is 21 weeks pregnant and she becomes more vulnerable of the COVID - 19.
