Joe Biden has won the 2020 United States Presidential elections. Biden is set to take oath in January 2021.
However, current President Trump has refused to accept the election result. Before Trump, there were 44 Presidents. Out of these, 35 willingly accepted defeated in elections when they lost and some Presidents when they completed their two terms they would themselves chose not to stand in elections again. Eight other Presidents died and one quit. In US history, no President has ever refused to vacate the White House when he lost an election.
So, what happens in the event that Trump refuses to concede and leave the White House?
According to the US Constitution, Trump will automatically stop being the President from 20th January.
Georgetown Law professor Rosa Brooks said, "If Biden is formally certified as the winner in the US Congress on January 6, he is officially going to be the next President, whether Trump concedes or not."
If Trump refuses to physically leave the White House after 20th January, he will most likely be physically removed. One former US official and two experts said that the Secret Service would physically remove Trump from the White House if he does not leave. Additionally, there's no rule in the US constitution that can extend a President’s tenure.
If no President has been chosen by January 20, 2021, then Nancy Pelosi - Speaker of the United States House of Representatives - will become the President. Trump has alleged fraud, he has filed 7 lawsuits in various American states challenging the results of the vote count and has alleged the votes were counted illegally. Since the counting of the votes began Trump has kept saying that he would file a case in the US Supreme Court.
What happens if Trump approaches the Supreme Court?
If the case goes to vote in the US Supreme Court, the nine judges of the Supreme Court will vote to make the decision. Now Trump himself has appointed 3 of the judges to the SC. Due to this when the judges vote, the decision may be in Trump’s favor. But if the Supreme Court votes for one candidate and the American Parliament votes for the other, then this will be the first time something like this happened in History. Nobody knows what will happen next.
Donald’s Trumps refusal to concede has made it very difficult to allow a smooth transition from the old president to the new. However, Biden’s team has already begun the informal work of transition anyway and will announce some of his new White House officials soon. Biden will also hold the first meeting to discuss the Coronavirus situation on 9th November 2020.
